Holistic Divorce

Holistic divorce is the idea that all of you - your own mind, body and spirit, your network of family, friends, neighbors, and co-workers will all be affected – one way or another - by your divorce. It's my job as a commissioner of the court to make sure that your final divorce decree meets all of the statutory and case law requirements. But it's my drive as a human being to help ensure that the things you value most survive your divorce.

The attorneys at Oberst DeFala Law, PC are mature and seasoned professionals who understand the bigger picture of where your divorce is heading. This may be your first divorce, but we have been involved in hundreds of divorces.

Together we work towards identifying what your highest priorities truly are, and how to help them survive this transition.

We accomplish this by working with you as a whole person, not just a financial affidavit. Together, we work with other professionals of your choosing, or I can recommend my associates. Certified mental health professionals, licensed financial experts and insured fiduciaries, vetted healing practitioners, and other trust-worthy attorneys or mediators, all of whom understand the specific and immediate nature of divorce and are available to engage with you as an induvial to bring your own life to its fullest next level.

The judicial system we see represented in TV dramas is available to help families divorce, but it does not always serve the greater needs of the human family going through divorce. Although the process includes inherent pain, regrets, recriminations, and the general need to take stock of what matters; it does not have to end in bankruptcy, foreclosure, hate and anguish. That is only one set of possibilities. My clients enjoy a broad range of outcomes, from greater financial stability, to heathier relationships with each other and their children

There are literally countless resources available to help maximize the positive opportunities that the transition of divorce gives you. In addition to the statutes, judicial norms, and case law, I help my clients enter into a fully realized new life. Whether an individual or – more frequently – as healthy and happy co-parents.

In short:

  • The divorce is not an isolated incident.
  • Holistic divorce is the idea that all of you - your own mind, body and spirit, your network of family, friends, neighbors, and co-workers will all be affected – one way or another - by your divorce.

Frequently Asked Questions

  • How is holistic divorce different?

The truth of divorce, like any transition, is that the impacts are wide-ranging and deep. A couple may believe that their divorce is only a question between the two of them. But it reverberates throughout all of their relationships, with their families, their in-laws, their mutual friends, and even their co-workers. By seeing divorce from this holistic perspective, we are better able to capture the positive outcomes that we want and focus on them throughout the transition period resulting in an overall better situation. Which, of course, is the goal of every divorce!

  • What is the difference between mediation and holistic divorce?

While a mediation ideally works with both parties to look at the overall picture of their entire relationship and the ecosystem within which the relationship exists, frequently mediation can be as simple as three people having a conversation in an isolation. By bringing in holistic divorce, we incorporate the big picture and as many outside sources as necessary to have an integrated whole view of the future lives of both parties and their families.

  • I thought divorce is a legal process why would I need other professionals?

Whether you get divorced through the courts or through my firm, it is frequently the case that additional professionals need to come into the conversation. We are well trained in the legal processes, statutes, case law, and judicial norms. Divorce is so much more than just the legal questions, though. Finances can be complicated or simple – sometimes it is just a matter of which expert looks at them. Families with their finances tied up in businesses, real estate, trust funds, or other vehicles, frequently benefit from having a certified divorce financial planner review the finances with them.

The same thing applies for the emotional impact of divorce not only on the parents, but also on their children, be they minors or adults. Emotional and psychological support helps clients decide how much of the past needs to be incorporated into the divorce procedure. And how to forge a healthy future for themselves, each other, and their children.

  • How much does divorce cost?

Financially, the cost of a divorce is determined by how much engagement the professionals need to have with the family in order to achieve their goals. However, emotionally, the cost can be much greater than just the financial cost. Sometimes cutting corners around saving money leads to greater long-term financial and emotional losses. A divorce should cost exactly as much as it takes for both parties to create the future that they most need.

  • Who pays for a divorce?

In the case of mediation, it is typical for the marital assets to be used as joint assets and pay for the mediator. In this way, neither party feels that the mediator is representing only one party, because the mediator is a neutral third professional.
