Why Estate Planning with Attorney Gary Oberst
Attorney Gary Oberst has spent his legal career helping high net worth and other clients plan how to pass assets to the next generation. Estate planning is the greatest act of love and kindness we can do for our heirs and beneficiaries.
Attorney Gary Oberst will meet with you and help you think through the facts of your particular family and the best way to protect your assets while you are still using them and distribute them appropriately when you are done.
The moment in their lives when your loved ones need you the most is the exact time you cannot be there for them. They are frequently confused and lost, in addition to the grief of their loss. Our work to help you plan your estate and protect your assets helps create a safety net for your family. We guide you in helping them be prepared to know what to do, what your wishes are, and how you have provided for their futures.
What Oberst DeFala Law Provides

Health Care Directives
Teach your loved ones how to care for you while you are still alive but may need extra attention.
Conservator of Person
Who will make decisions for you when your abilities are failing? If you have not chosen a conservator on your own, the court may appoint a member of the local bar association, or a relative who petitions for the role. You might want to let the court know - in advance - that if you ever do need a conservator, this is the person you most trust to fulfill the role.
Trusts
Intervivos Trusts ("between living people") assign rights while the benefactor and the beneficiary are both still alive. They can be permanent (irrevocable) or temporary (Revocable), depending on the purpose for which they are being constructed. Testamentary Trusts are created by the will at the time of the benefactor's demise. They are irrevocable, because the benefactor no longer needs the assets in question.
